Preamble
At a time when generative technologies are redefining creation, brands face a decisive choice: to undergo this transformation or to shape it.
This license establishes an unprecedented legal framework that allows trademark holders to voluntarily make certain brand identity elements available for use, transformation, and distribution. It lays the foundations for a creative ecosystem where innovation and intellectual property no longer oppose each other but rather nourish one another.
This license is based on a principle of partial, explicit, and reversible delegation of usage rights. It aims to encourage experimentation, innovation, and compatibility with new creative paradigms, particularly those related to generative systems.
This license constitutes neither a waiver of rights nor a renunciation of ownership. It delineates a territory of authorized uses while preserving the legitimate interests and asset value of the brands concerned.
It can be adopted by any individual or legal entity wishing to place brand elements under a regime of controlled openness.
This license is designed to weather technological evolutions and to endure beyond current uses.
Who am I?
I am Julien Lefevre, a 3D/VFX producer with 20 years of experience. I have fully automated the creation of digital twins and developed proprietary generative AI solutions. But this technical mastery runs into a legal wall: the impossibility of using real brands to demonstrate the potential of these technologies. This is exactly the problem that the entire generative AI industry is facing today.
Why Open Brands must exist
I consider it a golden rule that if technology can unleash creativity, it should not be hindered by artificial barriers. Brands possess an immense creative potential, but remain captive to legal frameworks that prevent them from revealing it.
This license exists to break that lock and finally allow innovation to express itself freely.
Open Brands License v0.2
Article 1 — Scope and Purpose
The purpose of this license is to authorize the creation, use, and distribution of derivative works based on a brand's identity elements, including through the use of generative systems (artificial intelligence, 3D modeling, algorithmic synthesis), in an open, ethical, and mutually beneficial framework.
It aims to unleash creative potential while respecting the integrity and value of the brands.
Article 2 — Rights Granted
By adopting this license, the brand grants to any user, without distinction or prior condition, the following non-exclusive, irrevocable, worldwide rights:
- Reproduce all or part of the brand identity elements made available;
- Adapt, transform, or derive from these elements freely, including through the use of generative tools, AI training, or any emerging technology;
- Distribute, communicate, or commercialize the derived content, including for a fee, on any medium and by any means.
Article 3 — Limitations and Prohibitions
This license comes with the following limitations:
- It does not imply any official link, partnership, or endorsement with the original brand, unless explicitly and formally indicated by that brand;
- It does not authorize the exclusive appropriation of the derived elements by filing trademarks, designs, patents, or any other form of intellectual property;
- It strictly forbids any malicious, defamatory, hateful, deceptive, or unlawful uses.
Article 4 — Reversibility and Withdrawal
The brand retains the ability to withdraw its elements from any platform or medium of distribution at any time. This withdrawal produces the following effects:
- Immediate effect: a prohibition on creating new derivative works from the moment of withdrawal;
- Preservation of acquired rights: existing creations remain valid and exploitable under the initial terms of the license.
Article 5 — Duration and Ownership
As long as an element remains published with reference to this license, the granted rights remain valid for an indefinite duration.
The brand retains the entirety of its intellectual property rights over the original elements. This license constitutes an authorization of use, not a transfer of rights.
Article 6 — Principle of Maximum Freedom
In the spirit of this license, no mandatory attribution, no reference link, and no prior approval are required to exploit the elements made available.
The fundamental goal is to foster the free flow of creativity and innovation by eliminating any administrative or technical friction that could hinder creation.
